A New York State representative, J. Gary Pretlow, has proposed legislation that would make some types of online poker legal by defining them as games of skill.

New York State Assembly Bill 1380, which aims to regulate legal online poker in the state, has been sent to the Racing and Wagering Board for examination. The proposal would alter New York State’s Racing, Pari-Mutuel Wagering and Breeding Law, adding a new section that redefines online Texas Hold’em and Omaha poker, “and any other poker game that the Board determines to be substantially equivalent to any of the foregoing,” as games of skill rather than chance — making them legal. The reasoning behind the bill is similar to the New York Appellate Court’s decision in March 2022 that declared fantasy sports to be a game of skill rather than a game of chance.
